The Tzolkin Corporation warrants to users that its software and services will, for a period of ninety (90) days from the date on which the user installs the software, be free from defects and faulty workmanship. If a defect occurs within ninety (90) days of installing the software, the user may contact Tzolkin to receive replacement software. This warranty to users is limited to replacing the TZO software and does not encompass any other damages, including but not limited to loss of profit, consequential, special, incidental, or other similar claims.
The Tzolkin Corporation's software and service is provided on an "as is" basis. Except for the warranty set forth above, Tzolkin Corporation makes no other warranties, either expressed or implied, regarding the software or service's quality, performance, merchantability, or fitness for a particular purpose. The Tzolkin Corporation does not warrant that its software or service will be free of errors, meet any user's requirements, or that the service will be uninterrupted or error free. Tzolkin Corporation is not responsible for any problems or damage caused by using either its software or its service. The user of Tzolkin software or services agrees to hold the Tzolkin Corporation and/or any persons associated with the creation, sales, marketing, or support of its software or service harmless for any problems arising from the sales, marketing, support or use of the software or service.

Some software developed by the Tzolkin Corporation allows for the transmission of images and data from a remote location to an Internet server. Tzolkin Corporation does not guarantee the accurate and complete transmission of the images or data and is not liable for damages, including but not limited to loss of profit, consequential, special, incidental, or other similar claims due to the loss of all or part of any images or data during transmission.
Some software developed by the Tzolkin Corporation provides the user with an easy method to set-up a webserver and router and/or firewall. To accomplish this Tzolkin Corporation's software opens certain ports in the router and/or firewall and routes web requests from the router and/or firewall to the user's designated computer. It is the responsibility of the user to take appropriate steps to ensure the security of all the user's computer systems and associated peripheral devices. Tzolkin Corporation is not responsible for damages, including but not limited to loss of profit, consequential, special, incidental, or other similar claims due to a security breach enabled by its software having opened ports in the user's router and/or firewall.
The Tzolkin Corporation retains the right to discontinue services to any user that it, at its sole discretion, deems to be using its services in violation of its Appropriate Use Policy as described within its web site at http://www.TZO.COM. Violations include but are not limited to sending unsolicited e-mail, an action sometimes known as SPAMMING, illegally distributing software or other copyrighted information, and electronically publishing or sending illegal information.
The Tzolkin Corporation offers its services as an option to the services provided by its user's Internet Service Providers. In some cases the Tzolkin Corporation's services may conflict with its user's Internet Service Provider's terms of service agreement. The Tzolkin Corporation does not advocate that users of its software or service violate the terms of their service agreement with their Internet Service Providers. |
