Text Formatter Plus Beta ? End User License Agreement with FormatBlue Software
Please read the following terms and conditions carefully before using the Text Formatter Plus beta software. By installing, copying or otherwise using the software, you agree to be bound by the terms of this Agreement.
If you do not agree to the terms of this Agreement, do not use or install the software. If you have any questions about this Agreement, please email license@formatbluesoftware.com.
LICENSE FOR THE BETA SOFTWARE
A copy of this software can be used for the beta test period so that the user may evaluate it. The sale, rental or leasing of the beta software is forbidden.
DISTRIBUTION
An exact copy of the beta software may be freely distributed to other users so they can test it.
You are prohibited from making any charge or requesting a donation for any such copies and from allowing the product to be distributed with any other products without prior permission in written form.
SUPPORT
The provision of any support, assistance or any other help to you by FormatBlue Software is given at the discretion of FormatBlue Software.
TERM OF THE LICENSE
The license will continue as long as the user adheres to the terms of this Agreement in relation to the use of the beta software and/or the distribution of the beta software.
However, if the user fails to comply with any of the license?s terms and conditions, the license will be terminated. If the license is terminated, the user agrees to destroy all their copies of the beta software.
However all limitations of warranty and liability contained in this license will remain in force after termination.
DISCLAIMER
This software (and any related support) is provided on ?as is? basis without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
The purchaser of the software must bear the entire risk of using the software and FormatBlue Software will have no liability to the user or any other third party for any damages whatsoever, including, but not limited to loss of data, economic loss or any other reason, even if this loss was foreseeable by FormatBlue Software or the possibility of loss was notified to FormatBlue Software.
Any liability of FormatBlue Software will be limited solely to the replacement of the product.
ADDITIONAL RESTRICTIONS
The user may not offer for sale, rent, lease, disassemble, reverse engineer, translate, modify or decompile the software, or otherwise attempt to discover the software?s source code. The software may not be merged or made the component of another program.
The software may be transferred to another user on a permanent basis as long as the current user retains no copies of the software and on the basis that the recipient agrees to the terms of this Agreement.
CONTRACTING PARTIES
If the software is installed on any computer owned by a company or other legal entity, then this Agreement is formed by and between the legal entity and FormatBlue Software. The individual executing this Agreement warrants and represents to FormatBlue Software that they have the authority to bind such entity to the terms and conditions of this Agreement.
GOVERNING LAW
This Agreement is governed by the laws of England in the United Kingdom. If any part or parts of this Agreement are found to be unenforceable or inapplicable, then the remainder of this Agreement will remain enforceable or applicable.
ENTIRE AGREEMENT
This license constitutes the entire Agreement between the user and FormatBlue Software and supersedes any other Agreement, whether written or oral. It may not be changed except by a written, signed Agreement.
