STL WebMail Server Software License
1. User agreement
STL grants you a non-exclusive, non-transferable license to use the program STL WebMail Server with which this license is distributed in compliance with the terms and to the conditions of this license agreement.
Installing, copying, downloading, approaching to, or otherwise using the PRODUCT SOFTWARE STL WebMail Server, the user agree to be bound by the conditions of the present contract.If you do not agree to the terms and the condition of this license agreement or you do not understand it, STL is not disposed to grant to the PRODUCT SOFTWARE STL WebMail Server in licence. In this case, you are held to abstain using or to copy the PRODUCT SOFTWARE STL WebMail Server, to destroy or return to STL all the copies of the Software and the Documentation in your possession or under your control.
Reciving and/or using the PRODUCT SOFTWARE STL WebMail Server you accept all the conditions of the present agreement inclusing those of the Evaluation Agreement and the Registered User Agreement .
This agreement is a contract stipulated between STL and the purchaser, customer, evaluator of the product software. If you do not mean to accept integrally the conditions of this agreement remove and destroy now all the copies of the product software installed on your computer. The PRODUCT SOFTWARE comes granted in licence use, does not come sold.
2. Ownership
You have no ownership fights in the Software STL WebMail Server . Rather, you have a license to use the Software as long as this License Agreement remains in full force and effect. Ownership of the Software, Documentation and all intellectual property fights therein shall remain at all times with STL . Any other use of the Software by any person, business, corporation, government organization or any other entity is strictly forbidden and is a violation of this License Agreement
3. Confidentiality
You acknowledge that the Software STL WebMail Server contains proprietary trade secrets of STL and you hereby agree to maintain the confidentiality of the Software using at least as great a degree of care as you use to maintain the confidentiality of your own most confidential information. You agree to reasonably communicate the terms and conditions of this Software License Agreement to those persons employed by you who come into contact with the Software, and to use reasonable best efforts to ensure their compliance with such terms and conditions, including, without limitation, not knowingly permitting such persons to use any portion of the Program for the purpose of deriving the source code of the Program or defeating the Key.
4. Copyright
Name STL, logo or the whichever graphical files that represents the product software cannot be used in no way in order to promote services or products developed by you with our software.
The rights and the copyright for the PRODUCT SOFTWARE STL WebMail Server (enclosed in example way, documentation, guides, tutorial, Help file, images, photographies, animations, video, audio, music, text,"applet", script Visual Basic Script, script Java Script, HTML pages, asp ecc. embedded, enclosed or distributed united or separately to the RODOTTO SOFTWARE), the enclosed printed material and whichever copy of the PRODUCT SOFTWARE are property of STL and are protect from the laws on the copyright of Italy, from the laws and the international dispositions on the protection of the copyrights. No one program, code, part, document, help file, guide, tutorial, image, audio video clip, file, text or sequence of images generated from the computer can be copied in whichever way from (you) the valutetor, customer, purchaser, owner of the product software to exception of the amble that re-enter in the use of the single same program. The owner and the rights for the intellectual property on the contents that you valutator, customer, purchaser, can approach using the PRODUCT SOFTWARE STL WebMail Server are property of STL or respectives titulars/owners and are protected from the copyright or other laws and deals on the intellectual property. This agreement do not you any rights to use this contents. If the PRODUCT SOFTWARE STL WebMail Server contains exclusively electronic documentation , the customer is authorized to print one copy of the aforesaid documentation electronic.
The customer cannot copy the enclosed printed publication material to the PRODUCT SOFTWARE STL WebMail Server.
All the rights not express granted to you are here reserved to STL.
You may not remove any proprietary notice of STL from any copy of the Software or Documentation
5. Restrictions of use and distribution
The valutator, customer, purchaser, owner of the product software cannot use or distribute software produced by STL for illegal scopes or in contrast with the law. The distribution of the product software associated with whichever other not legal considerabile material is forbidden. You (valutator, customer, purchaser, owner of the product software) cannot publish, visualize, find, rent, lease, modify, lend, distribute, or create derivative works based on the software STL WebMail Server or any part of thereof. You may not reverse engine, modify, decompile, decode, disassembe, translate, adapt, or take apart the software; neither you will try to generate the source code from the compiled code of software STL WebMail Server, with the exception and only for wath express allowed by the law in vigor and the software conditions of use.
* Separation of components. The PRODUCT SOFTWARE STL WebMail Server is granted in use licence which single produced. Its single component, parts cannot be copied, be red-use or separated to use they in more than a single computer .
* Trademarks. The present agreement does not grant to the customer any right in relation to eventual STL marks or Trademarks.
6. Limitation of responsibility
The valutator, customer, purchaser, owner of the product software, will not think responsible and it is engaged to defend and to refound STL against lawyers causes, claims, costs associates to defense for accusations that had to gush from use of software STL WebMail Server.
7. Limitation of warranty
STL WARRANTS FOR A PERIOD OF THIRTY (30) DAYS AFTER PURCHASE THAT THE SOFTWARE WILL OPERATE SUBSTANTIALLY IN ACCORDANCE WITH THE DOCUMENTATION. SHOULD THE SOFTWARE NOT SO OPERATE, YOUR EXCLUSIVE REMEDY, AND STL'S SOLE OBLIGATION UNDER THIS WARRANTY, SHALL BE, AT STL'S SOLE DISCRETION, CORRECTION OF THE DEFECT OR REFUND OF THE PURCHASE PRICE PAID FOR THE SOFTWARE LICENSE USE. ANY USE BY YOU OF THE SOFTWARE IS AT YOUR OWN RISK. THIS LIMITED WARRANTY IS THE ONLY WARRANTY PROVIDED BY STL REGARDING THE SOFTWARE STL WebMail Server. EXCEPT FOR THE LIMITED WARRANTY ABOVE, THE SOFTWARE IS PROVIDED"AS IS."TO THE MAXIMUM EXTENT PERMITTED BY LAW, STL DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. STL DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET ANY REQUIREMENTS OR NEEDS YOU MAY HAVE, OR THAT THE SOFTWARE WILL OPERATE ERROR FREE, OR IN AN UNINTERRUPTED FASHION, OR THAT ANY DEFECTS OR ERRORS IN THE SOFTWARE WILL BE CORRECTED, OR THAT THE SOFTWARE IS COMPATIBLE WITH ANY PARTICULAR PLATFORM. SOME JURISDICTIONS DO NOT ALLOW THE WAIVER OR EXCLUSION OF IMPLIED WARRANTIES SO THEY MAY NOT APPLY TO YOU .
8. Exclusion of responsibility for damages.
IN NO EVENT WILL STL OR ITS SUPPLIERS WILL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INCIDENTAL, FORTUITOUS OR CONSEQUENT DAMAGE (INCLUDING, WITHOUT LIMITATIONS, INDIRECT, SPECIAL DAMAGES, PUNITIVE OR EXEMPLARY DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION OR ACTIVITY INTERRUPTION, LOSS OF INFORMATION OR FOR ANY OTHER ECONOMIC LOSSES) DERIVING FROM THE USE OR CONSEQUENT DAMAGES OCCOURS BEFORE, DURING AND AFTER THE USE OF THE PRODUCT, ARISING OUT OF THE USE OF OR INABILITY TO USE TTH PRODUCT SOFTWARE STL WEBMAIL SERVEUR OR FOR ANY CLAIM BY ANY OTHER PARTY,OR FOR ANY OTHER CAUSE DERIVING FROM ANY OTHER REASON, EVEN IF STL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECOUSE SOME JURISDICTIONS DO NOT ALLOW THE WAIVER OR EXCLUSION OF IMPLIED WARRANTIES SO THEY MAY NOT APPLY TO YOU.
STL 'S AGGREGATE LIABILITY WITH RESPECT TO ITS OBLIGATIONS UNDER THIS AGREEMENT OR OTHERWISE WITH RESPECT TO THE SOFTWARE AND DOCUMENTATION OR OTHERWISE SHALL NOT EXCEED WITHOUT EXCEPTIONS THE GREATER AMOUNT BETWEEN THE LICENSE FEE PAID BY YOU FOR THE SOFTWARE AND DOCUMENTATION (MAXIMUM LIKE INDICATED FROM LIST STL FINAL CUSTOMER) AND THE SUM EQUIVALENT TO FIVE EURO (5 EURO), IN EXCHANGE YOU AGREE TO DESTROY OR RETURN TO STL ALL COPIES OF THE SOFTWARE, DOCUMENTATION AND REGISTRATION KEY AND TO CERTIFY IN WRITING THAT ALL KNOWN COPIES, INCLUDING BACKUP COPIES, HAVE BEEN DESTROYED. BECAUSE SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
9. Export Restrictions
THIS LICENSE AGREEMENT IS EXPRESSLY MADE SUBJECT TO ANY LAWS, REGULATIONS, ORDERS, OR OTHER RESTRICTIONS ON THE EXPORT FROM THE ITALY OF THE SOFTWARE OR INFORMATION ABOUT SUCH SOFTWARE WHICH MAY BE IMPOSED FROM TIME TO TIME BY THE GOVERNMENT OF THE ITALY. YOU SHALL NOT EXPORT THE SOFTWARE, DOCUMENTATION, OR INFORMATION ABOUT THE SOFTWARE AND DOCUMENTATION WITHOUT CONSENT OF STL AND COMPLIANCE WITH SUCH LAWS, REGULATIONS, ORDERS, OR OTHER RESTRICTIONS. .
10. Termination
This License Agreement is effective until it is terminated. You may terminate this License Agreement at any time by destroying or returning to STL all copies of the Software and Documentation in your possession or under your control. STL may terminate this License Agreement for any reason, including, but not limited to, if STL finds that you have violated any of the terms of this License Agreement. Upon notification of termination, you agree to destroy or return to STL all copies of the Software and Documentation and to certify in writing that all known copies, including backup copies, have been destroyed. All provisions relating to confidentiality, proprietary fights, and non-disclosure shall survive the termination of this Software License Agreement..
11. General
This License Agreement shall be construed, interpreted and governed by the laws of the ITALY without regard to conflicts of law provisions thereof. The exclusive forum for any disputes arising out of or relating to this License Agreement shall be an appropriate court sitting in MONZA MILAN, ITALY. This License Agreement shall constitute the entire Agreement between the parties hereto. Any waiver or modification of this License Agreement shall only be effective if it is in writing and signed by both parties hereto. If any part of this License Agreement is found invalid or unenforceable by a court of competent jurisdiction, the remainder of this License Agreement shall be interpreted so as to reasonably effect the intention of the parties.

Using of the Shareware version (no registered copy)
You can use for appraisal the Shareware version of the product software STL WebMail Server for a period of 30 (thirty) days to the term of which you must register and buy a licence of use for the program from STL or remove the product software and the documentation from your computer, destroy or give back to STL all the copies of the Software and the Documentation in your possession or under your control.
You can permit, in the valuation period, to other person to test the Shareware copies (no registered copy) of the product software STL WebMail Server. All the tester, customers will be however subject to the terms of the present agreement.
Registered User Agreement
Limitation of user licence
USER LICENCE GRANTS. this agreement grants you a non-exclusive, non-transferable license to use the program STL WebMail Server.
Installation and use of the Software registered copy. You can use/install only one copy of your software registered copy on only one server or personal computer. Any other installation or use of the registered software made on other computer including computers for the development solutions, Test of solutions, Cluster, or for the balancing require a new registered copy. You can make only one copy of backup of the registered product software for emergency proposed, assuring that only one copy of the registered product is installed and that nobody uses for no reason the services distributes through the emergency registered software copy .
If whichever person approaches services distributes, or interacts with they through the emergency copy or directly interacts with the emergency copy of the product software STL WebMail Server , this constitutes a violation of the present agreement.
The customer can use and make to use to thirds party the service supplied/delivered/builded through the PRODUCT SOFTWARE STL WebMail Server via Internet, to approach, to visualize, to execute or otherwise to interact with ("EXECUTING") the PRODUCT SOFTWARE, or one whichever previous version for the same operating system, for a limitless number of computer, workstation, terminals, PC, poket PC,"intelligent telephone"or other electronic digita device ("COMPUTER") exclusively for all the duration of the present agreement for the maximum number of CUSTOMERS CLIENT like specified in the registration product document (activation key). The customer can resell to thirds party subscriptions for the use of services rendered available through the PRODUCT SOFTWARE STL WebMail Server .
Right reserved
All Rights Reserved. STL reserves itself all the rights not express granted from the present agreement. Sell, distribute, lease or loan the REGISTERED COPY OF PRODUCT SOFTWARE is highly forbidden and it constitutes a violation of the present agreement. |
