LICENSE AGREEMENT
1.Subject Matter of this Agreement:
===================================
The subject matter of this agreement are the computer program and the user manual that are supplied on a data medium,
including any accompanying written documentation (hereinafter referred to as"Software").
With the purchase of this Software, you obtain ownership solely of the physical data medium and the written
documentation; in addition, you are granted the right to use the Software subject to the terms set forth herein.
If you do not agree to all of the terms in this agreement, you can return the Software prior to use for a full
refund of the purchase price.
Any additional use or utilization is excluded.
The computer program and the user manual are protected by copyright and trademark laws.
2.Scope of the License:
=======================
SmartStore AG grants you the non-exclusive, personal right (hereinafter also referred to as"License") for an unlimited
period of time to use the attached computer program on a single computer or workstation within a network only.
Any concurrent use of the Software on multiple computers or workstations requires the purchase of a multiple license from
SmartStore AG.
You may make a back-up copy of the Software, if this is necessary for ensuring the future use of the program.
You may not make any modifications or enhancements to the Software, except for your own use within the possibilities
provided by the Software for its intended use. SmartStore AG reserves the right to copy and distribute the Software or
modified or enhanced versions or essential parts thereof in any form and with any means.
3.Special Restrictions:
=======================
a)Any decompilation of the program codes is only permitted subject to the legal restrictions pursuant to ? 69 e
Urheberrechtsgesetz (German Copyright Law) and according to its provisions only, if SmartStore AG does not provide
the necessary information. Any further decompilation is excluded.
b)Any company names, trademarks, copyright references and other information regarding reservations of rights may
not be modified or erased; they have to be included in versions of the computer program or the accompanying material
that have been modified or enhanced with the consent of SmartStore AG.
c)It is explicitly prohibited to transfer the Software by way of gift, or to rent or lease the software.
d)You may only transfer the original version of the Software and as a whole together with this license agreement.
You may not transfer copies of the computer program or parts thereof or modified or enhanced versions or copies or partial
copies thereof. With the transfer of the Software, any right of use pursuant to this agreement is transferred to the new user.
In case the Software is transferred, any copies and partial copies of the computer program and modified or enhanced versions
and copies or partial copies thereof must be deleted promptly and completely or otherwise destroyed.
This provision also applies to any back-up copies.
4.Warranty:
===========
The Software is supplied pursuant to the current stage of development and was compiled in compliance with accepted
programming rules.
Please note that it is not possible to design computer programs such that they are without defect for any application
environment. SmartStore AG warrants that the computer program is usable as defined by the program description that is
applicable at delivery. Any minor diminution of its usefulness is irrelevant.
Any information contained in brochures, advertisement, documentation and other written material are only descriptions of
the computer program and do not include any representation of properties. Any representation of properties must be made
in writing. This also applies to information regarding the release of supplements and extensions.
The Software is provided without any warranty that the computer program fulfils the special requirements of the licensee.
The licensee is solely responsible for the selection, installation, and utilization and for the intended results.
Modified or enhanced versions of the Software are only covered by a warranty if evidence is produced that any defects exist
independently of the modifications or enhancements.
SmartStore AG replaces defect data media free or charge. In case the computer program is generally not usable pursuant to the
program description, the Software can be returned and will be replaced by a new computer program with the same title.
The extent of the warranty rights and obligations regarding the removal of defects and other faults is set forth in ? 8 and ? 9
of the General Terms and Conditions of SmartStore AG.
If SmartStore AG proves that defects under the warranty did not exist, it can demand reimbursement for any expenses it occurred
due to services rendered in connection with the notice of defect, except as otherwise provided. Any reimbursements are made
according to the compensation rates that are customary in the software industry.
5.Liability:
============
The liability of SmartStore AG for damages that arise from the use of the Software varies, depending on the duties that were
violated by SmartStore AG and the negligence it committed.
The extent of the liability is set forth in detail in ? 8 and ? 9 of the General Terms and Conditions of SmartStore AG.
6.Representations of the Licensee:
==================================
a)The licensee agrees to be bound by the provisions of this license agreement!
b)The representations regarding this agreement also represent that the licensee agrees to the General Terms of Conditions of
