The control can then integrate with your existing registration method to enable or unlock demos or pay-per-use software. The control uses 128-bit encryption to secure the buyer's information and then delivers it to your email inbox. You can use your existing merchant account(s) to process the payment which will have more favorable transaction fees than any e-commerce solution available. It is e-commerce without e-commerce fees! full merchant services are also available, providing a turnkey solution to sell and manage software sales. This End-User License Agreement ("EULA") is a legal AGREEMENT between you (either as an individual or a single entity) and GATEWAY SOFTWARE PRODUCTIONS for the software product Purchase Gateway, which includes computer software and may include associated media, printed materials, and"online"or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, THEN DO NOT INSTALL OR USE THE SOFTWARE PRODUCT.
SOFTWARE PRODUCT LICENSE
The"SOFTWARE PRODUCT"is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed not sold.
GRANT OF LICENSE. This EULA grants you, the user, the following rights:
A. YOU MAY: 1. install and use one copy of the SOFTWARE PRODUCT on a single computer or network. This copy is to be used by only a single user at a time. If you wish to use the SOFTWARE PRODUCT for more users, you will need an additional license for each user.
2. use the SOFTWARE PRODUCT up to a maximum of thirty days.
3. make one copy of the SOFTWARE PRODUCT for archive or backup purposes.
4. use a copy of the SOFTWARE PRODUCT on a home or portable computer if that copy is never loaded at the same time it is loaded on your primary computer.
5. distribute the runtime components of this package without royalty or obligation.
B. YOU MAY NOT: 1. use the SOFTWARE PRODUCT or make copies of it except as permitted in this License.
2. translate, reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT except to the extent the foregoing restriction is expressly prohibited by applicable law.
3. rent, lease, assign, or transfer the SOFTWARE PRODUCT except as set out in paragraph A above.
4. modify the SOFTWARE PRODUCT or merge all or any part of the SOFTWARE PRODUCT with another program.
C. TERM: This License shall continue for as long as you use the SOFTWARE PRODUCT as set out in Paragraph A above. However, it will terminate if you fail to comply with any of its terms or conditions. You must agree, upon termination, to destroy all copies of the Product. The Limitations of Warranties and Liability set out below shall continue in force even after any termination.
F. LIABILITY: THE SOFTWARE PRODUCT IS PROVIDED ON AN"AS IS"BASIS, WITHOUT ANY OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABLE QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE, OR COURSE OF DEALING. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GATEWAY SOFTWARE PRODUCTIONS OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF GATEWAY SOFTWARE PRODUCTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. |
