POP-UP MENU CREATOR END-USER LICENSE AGREEMENT ("EULA")
YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING THE SOFTWARE
BY PRESSING THE"YES"BUTTON YOU ACCEPT THESE TERMS AND CONDITIONS.
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU ARE NOT AUTHORIZED AND MAY NOT USE THE SOFTWARE.
1. DEFINITIONS
a. Software:"Pop-Up menu Creator"b. EULA: End User License Agreement
c. Licensee:
The End User, which may be:
i) An individual.
ii) A recognized legal entity.
iii) An Identified Operating Facility - as defined by Anoxy Software.
Identified Operating Facility:
i) A single Company within a single country.
ii) Government Department.
iii) An Educational Institution.
d. End-User Product: The output file generated by you, if any, using the Software. Examples of End-User Products include HTML files, JavaScript files and the like.
2. LICENSE
- Anoxy Software grants to you as an individual, a personal, non-exclusive license to install and use the End-User Product on any web pages you wish.
THIS AGREEMENT ALLOWS YOU TO USE THE SOFTWARE ON ANY NUMBER OF COMPUTERS.
3. RESTRICTIONS
You may not modify, rent, resell for profit, exchange, distribute or create derivative works based upon Pop-Up Menu Creator, the End-User product and any part thereof.
You may not distribute the Pop-Up Menu Creator and/or any End-User Product with other products (commercial or otherwise) and in any without prior written and official permission from Anoxy Software.
4. COPYRIGHT
Pop-Up menu creator - Copyright ¿ 1998-2002 by Anoxy Software. All rights reserved.
It is required that the Software contains the author's (Anoxy Software) copyright notification.
There is a mandatory copyright parameter ("Pop-Up DHTML menu is ¿ by Anoxy Software") contained within the HTML code which cannot be removed.
All title to and copyrights in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, text, incorporated into the Software), and any copies of the Software are owned by Anoxy Software.
5. OWNERSHIP
The foregoing license gives you limited rights to use Pop-Up Menu Creator and the End-User Product. You do not become the owner of, and Anoxy Software retains title to, Pop-Up Menu Creator and all copies thereof. All rights not specifically granted in this Agreement, including Federal and International Copyrights, are reserved by Anoxy Software.
6. TERMINATION OF THIS LICENSE
Anoxy Software may terminate this license at any time if you are in breach of any of these terms and conditions of use.
Upon such termination you must immediately destroy all copies of the Software and remove the End-User Product from all your Web Pages.
7. DISCLAIMER OF WARRANTIES AND OF TECHNICAL SUPPORT:
THE SOFTWARE IS PROVIDED"AS-IS.".
ANOXY SOFTWARE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE SOFTWARE OR ITS OPERATION.
TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, ANOXY SOFTWARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES OF NON-INFRINGEMENT.
8. LIMITATION OF DAMAGES:
IN NO EVENT SHALL ANOXY SOFTWARE BE LIABLE TO ANY PARTY FOR DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING DIRECTLY OR
INDIRECTLY FROM THE USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR OTHERWISE, EVEN IF ANOXY SOFTWARE HAS BEEN EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. AMENDMENTS
Anoxy Software may amend these terms and conditions at any time by a notice on its web site, which shall be binding upon you; accordingly, we urge you to visit the Anoxy Software web site periodically to review the then current and effective terms and conditions for use of the software. You may not revise or amend these terms and conditions without the prior written authorization of Anoxy Software. Certain provisions of these terms and conditions may be superceded by expressly designated legal notices or terms located within the Anoxy Software web site. |
