END-USER LICENSE AGREEMENT ("EULA").
This EULA is a legal agreement between you, either an individual or an
organisation, hereby referred to as the"END USER", and the author of
Parts Tracker (Andrew Kennedy) for the Part Tracker package and the
software, components, and documentation contained therein ("the
SOFTWARE").
By installing the SOFTWARE, you agree to be bound by all the terms of
this EULA. If you do not agree with all the terms of this EULA, you
must stop using the SOFTWARE and uninstall and delete it entirely from
computers on which it has been installed.
1. You may not reverse engineer, decompile or disassemble the SOFTWARE
or any of its components. Some components of the SOFTWARE are stored
in Microsoft (R) Visual Basic (R) for Applications project format
which, under normal circumstances, is viewable using the Microsoft
Visual Basic for Applications (VBA) Editor found within Microsoft
Office products. The components of the SOFTWARE stored as such are
protected by functionality within the Microsoft Access product, as
well as functionality within other components of the SOFTWARE. You
are not permitted to bypass such protection functionality in any way,
or view or modify VBA source (code or GUI structures).
2. The use of the SOFTWARE is controlled by a license key supplied to
you by the author or supplier of the SOFTWARE upon payment for the
SOFTWARE (or by agreement between you and the author in lieu of
payment). You are permitted to use the SOFTWARE without first making
payment (or obtaining such agreement in lieu of payment) and
obtaining a license key, for a period of time ("the TRIAL PERIOD").
The length of the TRIAL PERIOD is determined exclusively by the
author of the SOFTWARE and is built into the SOFTWARE. At the end
of the TRIAL PERIOD the SOFTWARE will cease to function until a
license key is supplied to you by the author or supplier of the
SOFTWARE. The length of the TRIAL PERIOD may be extended at the
discretion of the author of the software through supply to you,
by the author or supplier of the SOFTWARE, of a TRIAL PERIOD extension
key. You are not permitted to bypass or interfere with the function of
the license key or extension key checking employed by the SOFTWARE,
except by way of the supply of a license key or extension key by the
author or supplier of the SOFTWARE, at any time, including, but not
limited to the TRIAL PERIOD. The license key may remain valid for
future versions of the SOFTWARE at the discretion of the author of
the SOFTWARE. Some versions of the SOFTWARE may require a new license
key to be supplied by the author or supplier of the SOFTWARE, which
may, in some cases, at the discretion of the author of the SOFTWARE,
attract an additional charge.
3. When the SOFTWARE is uninstalled, some files may be left on the
computer. These files are the data file,"PartsTrackerData2_1.mdb",
and this EULA,"EULA.txt". These remain protected by the terms of
this EULA. You are permitted to keep these files without having
obtained a license key or TRIAL PERIOD extension key for a period of
thirty (30) days (or longer upon approval by the author of the
SOFTWARE), but you are not permitted to open, modify or gain use from
them in any way without having the complete Parts Tracker package
installed under the terms of this EULA. The purpose of allowing you to
keep the data file without having the complete package installed is so
that you are not forced to lose data created by you using the SOFTWARE
under the terms of this EULA, but you are not permitted to use the
files while the SOFTWARE is not installed under the terms of this
EULA. You are not permitted to keep these files if you have used them
outside the terms of this EULA.
4. You may not sell, rent, lease or transfer the SOFTWARE or any of
its components.
5. You may not use the Part Tracker Data File"PartsTrackerData2_1.mdb"in any way other than that prescribed by documentation/instructions
within the SOFTWARE or supplied to you by the author of the SOFTWARE.
This includes, but is not limited to, modifying, exporting, or adding
to, any data within the file. You are, however, permitted to make
backups of the Part Tracker Data File in its entirety for the
exclusive purpose of data loss recovery.
6.The SOFTWARE is provided"as-is,"without warranty. There is no
warranty for the SOFTWARE, either expressed or implied, including, but
not limited to, the implied warranties of merchantability and fitness
for a particular purpose. In no event shall the author be liable for
damages, including any general, special, incidental or consequential
damages arising out of the use or inability to use the program
(including but not limited to loss of data, or loss of business, or
data being rendered inaccurate, or a failure of the program to operate
with any other programs). Depending on local laws, this may not wholy
apply to you.
7. If you, with or without your knowledge, allow other persons to
access the SOFTWARE for which the author or supplier of the SOFTWARE
has granted a licensed to you, then you are responsible, to the
maximum extent permitted by applicable law, for ensuring that the
terms of this EULA are met. |
