ORMGen License Agreement
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Dankasoft Corp. for the Dankasoft software product identified above, which includes computer software and associated documentation. By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, copy, or use the SOFTWARE PRODUCT.
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
GRANT OF LICENSE
This license permits a single user to use the SOFTWARE PRODUCT on a single computer. The SOFTWARE PRODUCT is "in use" on a computer when it is loaded into temporary memory or installed into permanent memory.
RESTRICTIONS
Licensee shall not decompile, disassemble, decrypt, extract, or otherwise reverse engineer the SOFTWARE PRODUCT. The SOFTWARE PRODUCT may not be leased, assigned, or sublicensed, in whole or in part. The SOFTWARE PRODUCT is not designed or intended for use in on-line control of aircraft, air traffic, aircraft navigation or aircraft communications; or in the design, construction, operation or maintenance of any nuclear facility. Licensee warrants that it will not use or redistribute the SOFTWARE PRODUCT for such purposes.
DISCLAIMER OF WARRANTIES
The SOFTWARE PRODUCT and any related documentation are provided "AS IS" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you. In no event shall Dankasoft be liable to you or any third party for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data or profits arising out of or in connection with the use of the SOFTWARE PRODUCT.
SOFTWARE CHANGES
Dankasoft reserves the right at any time not to release or to discontinue release of the Software and to alter prices, features, specifications, licensing terms, release dates, general availability or other characteristics of the Software.
TERMINATION
Licensee may terminate this Agreement at any time by destroying all copies of the SOFTWARE PRODUCT. This Agreement will terminate immediately without notice from Dankasoft if Licensee fails to comply with any provision of this Agreement. Upon such termination, Licensee must destroy all copies of the SOFTWARE PRODUCT in its possession. |
