| MEmaster standard is a revolutionary program that enables everyone to produce their own interactive, multimedia applications quickly and effortlessly. Projects created with MEmaster standard can have an unlimited number of windows, which you can access via a Start menu like that in the Microsoft Windows operating system, or via a totally customizable menu bar. Users can open as many windows as they want at the same time inside the application's desktop, which also has a task bar that enables you to move between open windows in a simple, intuitive way. To make the construction of multimedia products as simple as possible, windows can be created from the templates in a special templates library. MEmaster standard contains about 500 templates, and each month dozens of new templates are added to the library. You can create your product's contents index as if it were a book's index, via a highly intuitive interface. But if you prefer, there is also a library of ready-made projects, which feature content indices like those of the most commonly used projects. All you have to do to make your own multimedia product is insert your contents into the windows. You can insert your contents via an innovative guided interface that takes you though and describes all the necessary steps. More expert MEmaster standard users can save time by using the quick insertion method. At any time, you can publish your project in the form of a program that can be run with a double click of the mouse. It is even possible to equip your product with a sophisticated installation and un-installation program, without any interventions more complicated than a simple customization. Applications created with MEmaster standard can be freely distributed, without having to pay any royalties. |

DISTRIBUTION OF UNREGISTERED EVALUATION VERSIONS OF THE PRODUCT. You may distribute complete unregistered evaluation copies of the SOFTWARE PRODUCT to third-parties, for the sole purpose of evaluation by them, on the condition that such parties agree to be bound by the terms of this Agreement. You must not charge more than a minimal fee, which must not exceed 10.00 euros, to cover the costs of media, distribution and handling or downloading of evaluation copies of the product, nor are you allowed to distribute same without clearly informing such third-parties that the software, documentation and related materials have not been registered with DUCK C.E. and are provided for the limited purpose of evaluation, in accordance with the terms of this agreement to which the aforementioned third-parties will be bound. Under no circumstances may you use or distribute only a portion of the SOFTWARE PRODUCT; you will provide a full and complete copy of the original software and the documentation package.
- DISTRIBUTION OF REGISTERED OR LICENSED VERSIONS OF THE PRODUCT PROHIBITED. You must not distribute copies of registered or licensed versions of the software, documentation or related materials to any third-parties, for any purpose. |

DUCK C.E. END-USER LICENSE AGREEMENT
Product: MEmaster standard
IMPORTANT - PLEASE READ CAREFULLY: This license agreement is a legal agreement between you (either an individual or a single entity) and DUCK C.E. for the abovementioned DUCK C.E. product, which includes computer software and possibly associated media, and may also include printed materials and electronic or online documentation ("SOFTWARE PRODUCT" or "SOFTWARE"). By installing, copying, or using the SOFTWARE PRODUCT in any way, you agree to be bound by the terms of this license agreement. If you do not agree to the terms of this license agreement, return the unused SOFTWARE PRODUCT promptly to the place you obtained it, to receive a full refund.
SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, and other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, it is not sold.
- GRANT OF EVALUATION LICENSE. DUCK C.E. grants you a limited, non-exclusive and non-transferable evaluation license. This confers the right to make copies of the unregistered, shareware evaluation version of the SOFTWARE PRODUCT, to only be used at one location, solely for evaluation purposes; the evaluation period shall not exceed twenty (20) days from the date of its original installation and use. The SOFTWARE must not be copied, distributed or used for any other purpose. Furthermore, you agree to destroy or erase all unregistered copies of the SOFTWARE PRODUCT when the twenty (20) day evaluation period expires or upon request of DUCK C.E., whichever occurs first. You agree that you must not reverse engineer, decompile or disassemble the SOFTWARE PRODUCT. Nothing herein shall be construed as a grant of any license to use or distribute any registered version of the product. THIS EVALUATION LICENSE SHALL NOT INCLUDE THE RIGHT TO DISTRIBUTE ANY RESULTS OR DOCUMENTS CREATED WITH THE SOFTWARE EVALUATION PRODUCT.
- GRANT OF LICENSE. This license agreement grants the following rights to every registered user of the SOFTWARE PRODUCT:
- SOFTWARE PRODUCT. You may install and use one copy of the SOFTWARE PRODUCT on a single computer.
- PROTECTIVE ELEMENTS. In order to manage, supervise and protect its legal rights, as well as to maintain the proper keep of hereby licensed conditions of use on the user's side, DUCK C.E. is entitled to integrate such program functions into the SOFTWARE, that effectively restrict or entirely stop functions of the SOFTWARE, whenever a use that conflicts with these conditions is detected. The user has no right to interfere, manipulate, restrict, break, change or bypass these protective elements or their functionality in any way. The user assumes responsibility for any loss of utilities or usage inherent in manipulating these protective elements.
The protection system allows the user to install again in another computer or into the same computer with considerably changed configuration characteristics, only if the first installation is disabled prior to the repeated installation through an appropriate built-in logout procedure.
- LIMITATIONS ON REVERSE ENGINEERING, DECOMPILATION AND DISASSEMBLY. You are not allowed to reverse engineer, decompile or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by an applicable law notwithstanding this limitation.
- SEPARATION OF COMPONENTS. The SOFTWARE is licensed as a single product. Its component parts must not be separated in order to be used on more than one computer.
- RENTAL. You are not allowed to rent or lease the SOFTWARE PRODUCT.
- SOFTWARE TRANSFER. You are allowed to permanently transfer all of your rights under this license agreement, provided you retain no copies, you transfer all of the SOFTWARE PRODUCT (including all component parts, the media and printed materials, any upgrades and this license agreement), and the recipient agrees to the terms of this license agreement. If the SOFTWARE PRODUCT is an upgrade, any transfer must include all prior versions of the SOFTWARE.
- TERMINATION. DUCK C.E. may terminate this EULA if you fail to comply with the terms and conditions of this license agreement, without prejudice to any other rights. You must destroy all copies of the SOFTWARE PRODUCT and all of its component parts, in such an event.
- DISTRIBUTION OF UNREGISTERED EVALUATION VERSIONS OF THE PRODUCT. You may distribute complete unregistered evaluation copies of the SOFTWARE PRODUCT to third-parties, for the sole purpose of evaluation by them, on the condition that such parties agree to be bound by the terms of this Agreement. You must not charge more than a minimal fee, which must not exceed 10.00 euros, to cover the costs of media, distribution and handling or downloading of evaluation copies of the product, nor are you allowed to distribute same without clearly informing such third-parties that the software, documentation and related materials have not been registered with DUCK C.E. and are provided for the limited purpose of evaluation, in accordance with the terms of this agreement to which the aforementioned third-parties will be bound. Under no circumstances may you use or distribute only a portion of the SOFTWARE PRODUCT; you will provide a full and complete copy of the original software and the documentation package.
- DISTRIBUTION OF REGISTERED OR LICENSED VERSIONS OF THE PRODUCT PROHIBITED. You must not distribute copies of registered or licensed versions of the software, documentation or related materials to any third-parties, for any purpose.
- UPGRADES. If the SOFTWARE is an upgrade from another product, whether that be from DUCK C.E. or from another supplier, you may use or transfer the SOFTWARE PRODUCT only in conjunction with that upgraded product, unless you destroy the upgraded product. If the SOFTWARE PRODUCT is an upgrade of a DUCK C.E. product, you now may use that upgraded product only in accordance with this license agreement.
- COPYRIGHT. All titles and copyrights in and to the SOFTWARE PRODUCT, the accompanying printed materials, and any copies of the SOFTWARE, are owned by DUCK C.E. or its suppliers. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions.
- REDISTRIBUTABLE COMPONENTS. DUCK C.E. grants you a non-exclusive royalty-free right to reproduce and distribute the results created by the SOFTWARE PRODUCT on the condition that: (a) the result has been created using a registered copy of the SOFTWARE PRODUCT; (b) you agree to indemnify, hold harmless, and defend DUCK C.E. and its suppliers from and against any claims or lawsuits, including lawyers' fees, that arise or result from the use or distribution of your resulting product, and (c) you otherwise comply with the terms of this license agreement.
MISCELLANEOUS
GOVERNING LAW. This license agreement is governed by the laws of the Italian Republic.

LIMITED WARRANTY. DUCK C.E. guarantees that the SOFTWARE PRODUCT'S associated media will be free from defects for a period of six (6) months from the date of receipt.
NO OTHER WARRANTIES. THE SOFTWARE PRODUCT AND THE ACCOMPANYING FILES ARE PROVIDED "AS IS" AND WITHOUT ANY WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments which the SOFTWARE PRODUCT may be put into, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The entire risk of using the program must be assumed by the user. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAW, IN NO EVENT SHALL DUCK C.E. OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF DUCK C.E. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
PARTIAL VALIDITY
If any of the above paragraphs is or becomes invalid, this will not affect the validity of the rest of this license agreement. |
