| MEmaster professional is a revolutionary program that enables non-programmers to produce their own interactive multimedia applications quickly and effortlessly. Applications created with MEmaster professional can have an unlimited number of windows, which users can open at the same time inside the application's desktop. Each window can contain multimedia elements of every possible type, from texts and video clips to images, 3D models, audio files and HTML pages. Guided step-by-step procedures enable you to make all of the multimedia elements active - capable of responding to a user command - and give life to complex actions, without the difficulties of having to use scripting languages. You can produce your application, composing the multimedia elements of each window and setting the properties of every element - in order to customize down to the tiniest detail - via a simple, intuitive interface. The interface features various palettes that are always shown and canvas windows that display the effects of the modifications made in real time. One of MEmaster professional's most interesting features is that it enables you to produce templates and store them in a library. Windows created using templates as a base already have all the desired multimedia elements, and just have to be customized using the contents of your choice. Templates and the windows they spawn are dynamically connected, so that (if you want) each modification to a template is automatically applied to the windows linked to it. You can publish your project in a distributable form at any time. MEmaster professional even creates application installer programs for you. Applications created with MEmaster professional can be freely distributed, without having to pay any royalties. |

DISTRIBUTION OF UNREGISTERED EVALUATION VERSIONS OF THE PRODUCT. You may distribute complete unregistered evaluation copies of the SOFTWARE PRODUCT to third-parties, for the sole purpose of evaluation by them, on the condition that such parties agree to be bound by the terms of this Agreement. You must not charge more than a minimal fee, which must not exceed 10.00 euros, to cover the costs of media, distribution and handling or downloading of evaluation copies of the product, nor are you allowed to distribute same without clearly informing such third-parties that the software, documentation and related materials have not been registered with DUCK C.E. and are provided for the limited purpose of evaluation, in accordance with the terms of this agreement to which the aforementioned third-parties will be bound. Under no circumstances may you use or distribute only a portion of the SOFTWARE PRODUCT; you will provide a full and complete copy of the original software and the documentation package.
- DISTRIBUTION OF REGISTERED OR LICENSED VERSIONS OF THE PRODUCT PROHIBITED. You must not distribute copies of registered or licensed versions of the software, documentation or related materials to any third-parties, for any purpose. |

DUCK C.E. END-USER LICENSE AGREEMENT

IMPORTANT - PLEASE READ CAREFULLY: This license agreement is a legal agreement between you (either an individual or a single entity) and DUCK C.E. for the abovementioned DUCK C.E. product, which includes computer software and possibly associated media, and may also include printed materials and electronic or online documentation ("SOFTWARE PRODUCT" or "SOFTWARE" indemnify, hold harmless, and defend DUCK C.E. and its suppliers from and against any claims or lawsuits, including lawyers' fees, that arise or result from the use or distribution of your resulting product, and (c) you otherwise comply with the terms of this license agreement.
MISCELLANEOUS
GOVERNING LAW. This license agreement is governed by the laws of the Italian Republic.
If you have any questions concerning this license agreement, or if you wish to contact DUCK C.E. for any reason, write to the contact address given in DUCK C.E.'s website: www.duckce.com.
LIMITED WARRANTY. DUCK C.E. guarantees that the SOFTWARE PRODUCT'S associated media will be free from defects for a period of six (6) months from the date of receipt.
NO OTHER WARRANTIES. THE SOFTWARE PRODUCT AND THE ACCOMPANYING FILES ARE PROVIDED "AS IS" AND WITHOUT ANY WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments which the SOFTWARE PRODUCT may be put into, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The entire risk of using the program must be assumed by the user. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAW, IN NO EVENT SHALL DUCK C.E. OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF DUCK C.E. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
PARTIAL VALIDITY
If any of the above paragraphs is or becomes invalid, this will not affect the validity of the rest of this license agreement. |
