| Intrepid Mouse File Launcher is a free file launching utility that is ideal for anyone distributing two or more programs or files on removable media. It lists all files available for launching and, if required, shows a description of each file. To open a file, the user simply selects a file from the list and clicks a button. No installation is required, and the program does not touch the Windows registry - simply run the program from wherever it is needed. File Launcher can be used 'locally' or on removable media, and you are free to use as many copies of the program as you like. The program can be localised for use in any language and through the use of a simple configuration file, File Launcher is easily customisable: use your own program title, specify all text labels within the program, provide your own program messages, override the default button sizes (so that the buttons are an appropriate size for your text), specify exactly which files are listed for launching, and display just filenames or show file paths. A description of each file can be included and you can provide end users with as much information as you like - e.g. comments, file sizes, system requirements, etc. End users can mark a checkbox to keep File Launcher open when launching a file, or they can clear the checkbox if they want File Launcher to close. |

INTREPID MOUSE FILE LAUNCHER END USER LICENCE AGREEMENT
1 GENERAL NOTICE
1.1 The copyright and other intellectual property rights in this Software and Documentation are owned by the Owner.
1.2 By downloading and running the Software you agree with the Owner to be bound by the terms of this Agreement which will govern your use of the Software.
2 DEFINITIONS
2.1 In this Agreement:
2.1.1"Documentation"means the explanatory written materials relating to and associated with the Software
2.1.2"File Launcher"means the executable file supplied with the Software and the accompanying configuration file
2.1.3"Files"means and includes the compressed file supplied by the Owner and all files subsequentally 'unpacked' from the compressed file
2.1.4"Owner"means Intrepid Mouse Limited, company incorporated under the laws of England with registration number 4153274
2.1.5"Person"means and includes any natural person, firm, partnership, company, corporation, association, organisation, government, state, foundation and trust (in each case whether or not having separate legal personality)
2.1.6"Software"means and includes
2.1.6.1 all the contents of the Files with which this Agreement is provided; and
2.1.6.2 all upgrades, modified versions, updates and additions to and of the Software
3 LICENCE
3.1 You are permitted to:
3.1.1 Run multiple copies of the Software on any computer which is under your control;
3.1.2 Distribute the File Launcher free of charge for both personal and commercial use;
3.1.3 Make a copy of the Software for back-up purposes in support of the permitted uses. The copy must reproduce and include the Owner's copyright notice. Such copy shall be the property of the Owner and this Agreement shall apply to such copy as it applies to the Software;
3.2 You are not permitted:
3.2.1 To sell or permit the sale of the Software;
3.2.2 Except as expressly permitted by this Agreement and save to the extent and in the circumstances expressly permitted by law, to rent, lease, sub-licence, loan, copy, modify, adapt, merge, translate, reverse engineer, decompile, disassemble or create derivative works based on the whole or any part of the Software or the Documentation or use, reproduce or deal in the Software or the Documentation or any part thereof in any way.
3.3 You must not use the Software for the creation, production, supply or publication of any work or material:
3.3.1 That is defamatory, obscene or pornographic; or
3.3.2 In any manner that is illegal.
4 TERM
4.1 This Agreement is effective until you terminate it by destroying the Software and the Documentation together with all copies. It will also terminate if you fail to abide by its terms. Upon termination you agree to destroy all copies of the Software and the Documentation including any Software stored on the hard disk of any computer under your control.
5 OWNERSHIP
5.1 The Owner shall at all times retain ownership of the Software.
6 WARRANTIES
6.1 The Owner warrants that the Software will perform substantially in accordance with the Documentation (provided the Software is properly used) and that the Documentation correctly describes the operation of the Software in all material respects.
6.2 The Owner does not warrant that the Software will meet your requirements or that the operation of the Software will be uninterrupted or error-free or that defects in the Software will be corrected. You shall use the Software at your own risk and in no event will the Owner be liable to you for any indirect or special loss or damage of any kind (except personal injury or death resulting from the Owner's negligence or breach of this Agreement) including any form of lost profits or consequential loss arising from your use of or inability to use the Software or from errors or deficiencies in it whether caused by negligence or otherwise. The Owner shall also not be liable for any failure by the Software to provide any functions not specified in the Documentation.
6.3 The express terms of this Agreement are in lieu of all warranties, conditions, undertakings, terms and obligations implied by statute, common law, trade usage, course of dealing or otherwise all of which are hereby excluded to the fullest extent permitted by law.
7 GENERAL
7.1 This Agreement constitutes the entire agreement and understanding between you and the Owner and supersedes any prior written or oral representations, statements, agreements or understandings relating to the Software.
7.2 No variation or amendment of this Agreement shall be binding unless made in writing and signed by a duly authorised officer of the Owner.
7.3 If any provision of this Agreement is found to be illegal void or unenforceable then it will be deemed to be omitted and the remaining provisions of this Agreement shall continue in full force and effect.
7.4 The headings in this Agreement are for convenience only and are not intended to have any legal effect.
8 LAW
8.1 English Law shall govern the construction validity and performance of this Agreement in all respects. |
