Collectively or individually known as the Product.
This EULA is a binding legal agreement between you (either an individual or a single entity known as the Licensee) and Business Functions Ltd, 189 Prospect Road, Woodford Green, ESSEX IG8 7NF ("BFL"), the author of the Product.
The Product includes software in object code form, navigation, usage and installation instructions and other information as may be made available or published by BFL
Ownership of the copyright , trademark and all other rights, titles and interest in the Product at all times rests with BFL.
Subject to the terms and conditions of this EULA, BFL hereby grants to the Licensee a non-exclusive, personal, perpetual, restricted and non-transferable right to use the Product. The Licensee's use of the software shall constitute acceptance of, and a contractual commitment to, the EULA. The Licensee may only make copies of the software to the extent that it is necessary to support its normal use and for backup purposes, with exception of Business Functions Basic Edition, which you are conversely encouraged to copy and distribute freely. The Product is for installation on a single Personal Computer. The Licensee will not reverse engineer any part of the Product. The product is supplied on an "as is" basis " and "with all faults, defects and errors", and without warranties or conditions, express or implied. In particular, there are no warranties as to performance, merchantability or fitness for a purpose. In no event shall BFL its employees or Directors be liable or responsible for the consequences of using the Product, including any indirect, third party, incidental, consequential or exemplary expenses, costs , liability, loss or damage. In any event the maximum liability shall not exceed the amount paid by the Licensee for the Product. The Licensee expressly holds BFL its employees and Directors harmless from any and all liability of any kind or nature whatsoever to your customers, distributors and third parties which may arise from your acts under the EULA. |
