GOZTUN VINC.
AiO FLASH Mixer 2.0 (EVALUATION) IS TRIALWARE.
REDISTRIBUTION IS PERMITTED.
IMPORTANT -- READ CAREFULLY: By clicking on the "I hereby agree to compy with these conditions" button or by installing, downloading, copying or otherwise using AiO FLASH Mixer?2.0 Evaluation, ("Software"), and all ccompanying documentation ("Documentation") you, the user, agree to be and are hereby bound by the terms and conditions of this License Agreement ("Agreement"). If you do not agree to the terms and conditions stated in this Agreement, you must promptly stop using the Software and all accompanying Documentation.
1. GRANT OF LICENSE FOR 30 DAYS
GOZTUN VINC. hereby grants you, the user, a non-exclusive license to use the Software and Documentation for evaluation purposes without charge for a period of thirty (30) days. Any use of this Software and Documentation beyond the thirty (30)-day evaluation period requires that you, the user, register with GOZTUN VINC. by way of a purchase order which will correspondingly entitle the Software and Documentation to be upgraded to the full license copy of AiO FLASH Mixer?2.0.
Use of this Software and Documentation is permitted only to the extent reasonably required in the thirty (30) days to determine whether to register and upgrade the Software and Documentation to the full license copy of AiO FLASH Mixer?2.0. Unregistered use of this Software and Documentation after the thirty (30)-day evaluation period is in violation of U.S. and international copyright laws.
2. DISTRIBUTION
You are hereby granted permission to duplicate and distribute the Software and Documentation freely; give exact copies of the Software and Documentation to anyone; and distribute the Software and Documentation in its unmodified form via any electronic means.
You are expressly prohibited from charging, or requesting donations, for any such copies, however made; from distributing the Software and/or Documentation with other products or as a part of any package or publication or in support of any service, commercial or otherwise, without prior written permission and agreement from GOZTUN VINC. The Software and Documentation must not be distributed to support any profit-generating activity, even if the Software and Documentation are being distributed freely.
The Software and Documentation must be distributed together as a whole without any modifications. No files or contents may be added to or removed from the Software and Documentation in the course of distribution. No individual parts or components of the Software and/or Documentation may be distributed. You may not remove or modify the copyright and proprietary notices or labels from the Software or Documentation.
3. LIMITATIONS
You may not disassemble, modify, reverse-engineer, adapt, decompile, translate or create derivative works based upon the Software or the Documentation or any part thereof in any way whatsoever without the written consent of GOZTUN VINC.
Except as expressly permitted in this Agreement, you may not separate any parts of the Software or Documentation for use on more than one computer.
You may not lease, rent, assign, sell, resell or otherwise transfer any of the thirty (30)-day licensing rights in the Software or Documentation to any other person or parties whomsoever.
You may not use the Software or Documentation for any use prohibited by law.
4. COPYRIGHT
All title, ownership rights, and intellectual property rights in and to the Software and Documentation are owned by GOZTUN VINC. or its licensors. The Software and Documentation are protected by the copyright laws of the United States and international copyright treaties. All title, ownership rights and intellectual property rights in and to the content accessed through the Software including any sample content contained in the Software is the property of the applicable content owner and may be protected by applicable copyright or other laws. THIS LICENSE DOES NOT GIVE YOU, THE USER, ANY RIGHTS TO SUCH CONTENT AND GOZTUN VINC. SHALL HAVE NO LIABILITY WITH RESPECT TO YOUR USE OF ANY SUCH CONTENT.
5. DISCLAIMER OF WARRANTY
THE SOFTWARE AND DOCUMENTATION ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOZTUN VINC. FURTHER DISCLAIMS ALL WARRANTIES WHETHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SOFTWARE AND DOCUMENTATION LIES WITH YOU, THE USER. IN NO EVENT SHALL GOZTUN VINC. OR ITS LICENSORS OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE SOFTWARE OR DOCUMENTATION, EVEN IF GOZTUN VINC. GOZTUN VINC. DOES NOT WARRANT THAT YOUR REQUIREMENTS WILL BE MET WITH THE SOFTWARE FUNCTIONS OR THAT THE DOCUMENTATION AND SOFTWARE OPERATION WILL BE ERROR-FREE OR UNINTERRUPTED OR THAT DEFECTS WILL BE CORRECTED. GOZTUN VINC. SHALL ALWAYS RESERVE ITS RIGHTS AND DISCRETION TO CORRECT ANY DEFECTS IT SEES FIT AND TO MAKE AVAILABLE FURTHER RELEASES AND UPGRADES AS AND WHEN IT DEEMS NECESSARY.
This Agreement constitutes the complete agreement between you and GOZTUN VINC. with respect to the subject matter hereof and supersedes any and all prior or contemporaneous oral or written agreements, representations, negotiations, understandings, communications or other dealings between you and GOZTUN VINC. If any part of this Agreement is found to be void, unenforceable or invalid, it shall not affect the other provisions of this Agreement.
7. MODIFICATION OF AGREEMENT
This Agreement may not be modified except in writing duly signed by an authorized person or persons of GOZTUN VINC. and you.
8. TERMINATION
Without prejudice to any other rights, GOZTUN VINC. reserves the right to terminate this Agreement if you, the user, fails to comply with the terms and conditions of this Agreement. In such event, you must promptly stop using the Software and all accompanying Documentation. |

This Agreement licenses Software to you [either an individual or single entity]
from GozTun.com and contains warrant and liability disclaimers.
By installing, copying or otherwise using this Software, you are confirming
that you have read and understand this Agreement and agree to be bound by the terms of this Agreement.
If you do not agree with the terms of this Agreement, you should not install or use this Software.
1. Definitions
"Software" means all of the contents of the files, disk(s), CD-ROM(s) or other media with which this Agreement
is provided.
"Use", "Used" or "Using" means to access, install, download, copy or otherwise benefit from using the functionality
of the Software in accordance with the Documentation.
"Computer" means one central processing unit (CPU) that accepts information in digital or similar form and
manipulates it for a specific result based on a sequence of instructions.
"Permitted Number" means one (1) unless otherwise indicated under a valid license granted by GozTun.com.
2. Software License
2.1 As long as you comply with the terms of this End User License Agreement, GozTun.com grants to you a
non-exclusive license to Use the Software for the purposes described in the Documentation, as further set forth below.
2.2 You may install and Use a copy of the Software on your compatible Computer, up to the Permitted Number of Computers
2.3 Backup Copy. You may make one backup copy of the Software, provided your backup copy is not installed or Used on
any Computer. The backup copy must included all copyright information contained on the original.
You may not transfer the rights to a backup copy unless you transfer all rights in the Software as provided in the
Transfer section in this Agreement.
2.4 Portable Computer Use. The primary user of the Computer on which the Software is installed may also make a
second copy for his or her exclusive use on a portable Computer provided the Software on the portable Computer
is not being used at the same time the Software on the primary Computer is being used.
2.5 Except as permitted by applicable law and this License, you may not modify, reverse engineer, disassemble, decompile the Software.
3. Transfer
You may not rent, lease, sell, sublicense, un-bundle and/or repackage for distribution or resale, or authorize all
of any portion of the Software to be copied onto another users Computer except as may be expressly permitted herein.
You may, however, transfer all your rights to Use the Software to another person or legal entity provided that:
(a) you transfer this Agreement, the serial number(s), Software and all other software or hardware bundled, packaged
or pre-intalled with the Software, including all copies, Updates and prior versions; (b) you retain no copies,
including backups and copies stored on a computer; and (c) the receiving party accepts the terms and conditions
of this Agreement and any other terms and conditions upon which you legally purchased a license to the Software.
4. Termination
Without prejudice to any other rights, GozTun.com may terminate this Agreement if you fail to comply with the
terms and conditions of this Agreement. In such an event, you must destroy all copies of the Software.
5. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT
LIMITATION WARRANTIES THAT THE SOFTWARE IS (A) FREE OF DEFECTS OR ERRORS, (B) VIRUS FREE, (C) ABLE TO MEET ANY
REQUIREMENTS OF YOU OR ANYONE ELSE, (D) ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, (E) MERCHANTABLE,
(F) FIT FOR A PARTICULAR PURPOSE OR (G) NON-INFRINGING UNLESS SUCH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION.
GozTun.com SHALL HAVE NO LIABILITY WITH RESPECT TO USE OF THE SOFTWARE.
6. Limitation of Liability
IN NO EVENT WILL GozTun.com, ITS EMPLOYEES, DISTRIBUTORS, SUPPLIERS, DIRECTORS, NOR AGENTS SHALL BE LIABLE
FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES IN CONNECTION WITH THE SOFTWARE OR
THIS AGREEMENT, EVEN IF GOZTUN.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall GozTun.com's liability in connection with the Software, regardless of the form of action,
exceed the amount paid for this License to the Software.
Some jurisdictions do not allow the foregoing limitations of liability, so the foregoing limitations may not apply to you.
7. Export
You may not download or otherwise export or re-export the Software except in full compliance with all applicable
laws and regulations.
If any provision of this Agreement shall be invalid, the validity of the remaining provisions of this Agreement
shall not be affected.
